1. What this Platform is
Fare ("Platform", "we", "us") is an online marketplace operated by [LEGAL ENTITY NAME], registered in [Estonia], registration number [NUMBER], registered address [ADDRESS] ("Fare"). The Platform connects:
- Buyers are people who purchase goods listed on the Platform;
- Sellers are farmers, growers, home producers, and craft-goods makers who list goods for sale; and
- Drivers are independent individuals who provide delivery services, where delivery is not arranged directly between Buyer and Seller.
Fare acts as an intermediary only. Fare is not a party to the sale contract formed between a Buyer and a Seller, does not take ownership of, handle, store, or transport any goods listed on the Platform (except where Fare itself is disclosed as the Driver in a specific transaction), and is not the food business operator for any food product sold through the Platform.

2. Agreement to these Terms
By creating an account or using the Platform, you agree to these Terms. If you do not agree, you must not use the Platform. You confirm you are at least 18 years old, or that you have a parent's or legal guardian's permission.
3. Accounts and seller categories
3.1 General
You are responsible for keeping your account credentials secure and for all activity under your account. You must provide accurate, current information. You may not create accounts under false identities or on behalf of others without authorisation.
3.2 Seller type declaration
When registering as a Seller, you must declare whether you are:
- (a) a private individual selling surplus or self-grown/self-made goods on a non-regular, non-professional basis; or
- (b) a trader, a person or entity acting for purposes relating to their trade, business, craft, or profession, including any registered or legally-required-to-be-registered food business operator.
This declaration affects which disclosures and buyer protections apply to your listings. Fare may request supporting information and may reclassify an account if the declared status appears inaccurate (for example, based on listing frequency or volume).
3.3 Trader information (Know-Your-Business-Customer)
If you are a trader, before you may list goods you must provide and keep current:
- your full legal name and, if applicable, trading name;
- your address and contact details (email, phone);
- where applicable, your business registration number, VAT number, or equivalent; and
- where you sell goods subject to mandatory food-business registration or approval (see Section 4.4), your registration/approval number issued by the relevant competent authority (e.g. PTA in Estonia, PVD in Latvia, VMVT in Lithuania).
Fare will make reasonable efforts to verify this information, including automated checks and, where necessary, spot checks against public registers, before or shortly after your first listing goes live, and periodically thereafter. Fare may suspend or remove listings or accounts where required information is missing, appears false, or cannot be verified. Some of your trader information will be made available to Buyers and, where legally required, to competent authorities, in accordance with our Privacy Policy.
4. Buying and selling
4.1 Seller responsibility
Sellers are solely responsible for the legality, safety, quality, accurate description, and fitness for purpose of the goods they list, including compliance with all applicable food-safety, hygiene, labelling, and consumer-protection law in the country where they operate and sell.
4.2 Pricing
Sellers must accurately describe goods and price them in euros, inclusive of all applicable taxes.
4.3 Order formation
An order is a binding contract of sale directly between Buyer and Seller, concluded when the Seller accepts the order through the Platform. Fare may cancel or refuse listings and orders that violate these Terms or applicable law.
4.4 Regulated goods, additional seller warranties
If you list products of animal origin (including but not limited to meat, cured or smoked meat products, sausages, dairy, cheese, or fish products) or any other product category subject to mandatory food-business registration or approval under applicable national law, you additionally represent and warrant that:
- you hold all registrations, approvals, or notifications required by the competent authority for the production and sale of that product, at any volume;
- any meat used originates from an approved/registered slaughterhouse or processing establishment, as required by EU Regulation 853/2004 and national implementing rules;
- you will provide your registration/approval number to Fare and keep it current, and will display it or make it available as required by applicable distance-selling rules;
- you will maintain any records required by law (e.g. quantities, dates, provenance) and make them available to the competent authority on request; and
- you will immediately notify Fare if your registration or approval is suspended, revoked, or lapses.
Listing a regulated product without meeting these requirements is a material breach of these Terms and may result in immediate suspension or removal, in addition to any liability you may have under applicable law.
4.5 Non-regulated primary produce
If you are a private individual or small-volume grower selling unprocessed plant products (vegetables, fruit, herbs) below the small-quantity thresholds set by the competent authority in your country, you may not be required to hold a registration number. You remain responsible for confirming your own status with the relevant authority and for complying with any notification duty that applies to you.
4.6 Buyer responsibility
Buyers are responsible for placing accurate orders and for reviewing listing information, including any allergen or ingredient information provided, before ordering.
5. Distance-selling information and withdrawal rights
Orders placed through the Platform are concluded at a distance. Before completing an order, Buyers will be shown the Seller's identity, the main characteristics of the goods, the total price, and delivery arrangements.
Under EU consumer law, Buyers generally have a 14-day right of withdrawal for online purchases. However, this right does not apply to goods liable to deteriorate or expire rapidly, which includes most fresh food, produce, and perishable goods sold on this Platform. Any product-specific withdrawal terms will be shown at checkout.
6. Delivery
Where delivery is provided by a Driver, Drivers are independent providers, not employees of Fare, and Fare is not responsible for their conduct. Where Buyer and Seller arrange their own handover or delivery, this occurs entirely outside Fare's involvement and at their own arrangement and risk. Delivery times shown on the Platform are estimates only.
7. Fees
Any fees for using the Platform will be shown before you confirm a transaction. Fare may change its fees with reasonable notice.
8. Acceptable use and reporting illegal listings
8.1 Prohibited conduct
You may not use the Platform to list illegal goods, goods you do not own or have the right to sell, or goods that violate food-safety, labelling, or consumer-protection law. You may not misuse the Platform, interfere with its operation, or access accounts you do not own.
Listings may not contain personal contact information such as email addresses or phone numbers. All communication between buyers and sellers must take place through the Platform's built-in messaging system. Listings that include contact information may be removed and the seller's account may be suspended.
8.2 Reporting mechanism
Any user, or any third party, may report a listing or account they believe is illegal or non-compliant using [REPORT MECHANISM / LINK / EMAIL]. Reports should include enough detail to allow Fare to assess the listing. Fare will review reports and take appropriate action, which may include removing a listing, requesting further information from the Seller, or suspending an account, in accordance with our internal moderation process. Fare will inform the reporter of the outcome where required by law.
8.3 Effect of actual knowledge
Where Fare obtains actual knowledge of illegal content or activity on the Platform, whether via a report or otherwise, Fare will act expeditiously to remove or disable access to it.
9. Liability
To the maximum extent permitted by law, Fare provides the Platform "as is". Fare is not liable for the goods sold, for the conduct of Sellers, Buyers, or Drivers, or for indirect or consequential losses. This does not limit liability that cannot be excluded by law, including liability arising from Fare's own failure to act on actual knowledge of illegal content as described in Section 8.3.
10. Termination
You may close your account at any time. Fare may suspend or close accounts that breach these Terms, applicable law, or where a required registration/approval is missing, false, suspended, or revoked.
11. Changes to these Terms
Fare may update these Terms from time to time. Material changes will be notified in advance where required by law. Continued use of the Platform after changes take effect means you accept the updated Terms.
12. Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Estonia, without prejudice to any mandatory consumer-protection or food-law provisions of the country in which a Buyer or Seller is located, which continue to apply where required by law. Disputes shall be submitted to the courts of Estonia, without prejudice to a consumer's right to bring proceedings in their own country of residence where applicable law provides for this.
